The OWNER agrees A. He/She will make all arrangements for the following and assume the cost of: 1. Health Certificate (If Required) 2. Negative Coggins (EIA) Test (Required) 3. Halter and Lead Rope (Required). 4. 1 bale of hay per horse (supplied at pick up). B. OWNER MUST INITIAL CHOICE Owner understands and acknowledges that insurance is not provided to the Owner by the Transporter. If the Owner elects not to secure insurance, then he/she agrees that he/she assumes all expenses or liabilities associated with the transport or care of the aforementioned horse(s). Contract for Owner _________________________ Page 2 of 3 ______________Owner will maintain (and provide proof of, if requested) current horse Mortality insurance OR ______________Owner elects not to carry Horse Mortality Insurance and assumes ALL risk to their own horse (to include, but not limited to, injury, death, illness, disease, physical damage or harm). C. OWNER will (1) pay the transporter the sum of $___________ (US funds) for the transport of the aforementioned horse(s) from and to the locations indicated above; (2) reimburse the transporter for any and all veterinary services, drugs or any other medical supplies in the event of an emergency or as the transporter deems necessary for the well-being of the aforementioned horse(s). D. Transporter shall be entitled to a lien against the transported horse(s) for the value of the services rendered and shall be entitled to enforce said lien in accordance with appropriate state laws. E. Balance of shipping fees to be paid PRIOR TO UNLOADING of any Horse(s). No exceptions to this. ONLY cash or cashier’s checks will be accepted. 3. Other Charges The rate quoted is for door to door delivery and care of your horse(s). However, surcharges may apply for any of the following: *Waiting time at barn for pick up or delivery person will be charged a rate of $50.00 per hour after the first 30 minutes of waiting. *A “Hard Loader Fee” of $50.00 per hour may be applied after the first 60 minutes of attempted loading or unloading. *Difficult access roads to locations will have a surcharge if not disclosed in the original quote. Unpaved roads are hard on horses and equipment and must be disclosed PRIOR to the trip. *Any damage to the trailer or equipment caused by your horse(s). 4. Cancellations The OWNER understands that in booking his/her horse(s), that he/she has reserved a space on the Trailer, and that other horses may have been refused this space as a result of the reservation. As such, cancellations within 24 hours of departure are subject to a cancellation fee of 50% of the total shipping charges. Furthermore, transporter reserves the right to cancel (as a last resort only) the trip due to hazardous weather, mechanical difficulties, or extenuating circumstances. The transporter agrees that they will use diligence to safely transport, feed and care for the aforementioned horse(s) in a good animal husbandry like manner. If problems arise with diet, health, or injury, transporter will notify owner in a timely manner. 6. In the event the horse(s) are in need of veterinarian services, the transporter will immediately notify the owner. In the event the owner can not be reached, the transporter is hereby authorized, as an agent for the owner, to contact the first available licensed veterinarian of his/her choice. ALL fees charged by said veterinarian shall be the sole and exclusive responsibility of the OWNER, with no liability whatsoever on the transporter for such fees. 7. OWNER hereby voluntarily releases and forever discharges the transporter and its agent from any and all liabilities, claims, demands, actions, or rights of actions, which are related to, rise out of, or are in any way connected with the transport of the aforementioned horse(s), including but not limited to the negligent acts or omissions of the transporter, its agents or employees, and all other persons or entities, for any and all injuries, death, disease, illness or damage to the aforementioned horse(s) arising from or in connection with the transport, care or feeding of said horse(s) or from any claims asserted by other third parties. OWNER’s signature below indicates the following: OWNER understands that this is the entire agreement between the owner and transporter, its agents or employees, and it supercedes and can not be modified or changed in anyway by the representations of any employee or agent or the transporter or owner. My signature below indicates that I understand all three pages of this contract and agree to be bound by its terms in its entirety.
